Terms of Offer for Sale
These ‘Terms of Offer for Sale by ‘Chartered Express Connecting Professionals’ or Chartered Express’ do business through its website ‘charteredexpress.in’ (hereinafter referred to as “CE”) with the users of its website (hereinafter referred to as “Buyer “or “User”) describe, inter alia, the terms of the offer for sale of goods and services for a consideration in cash or cash equivalents.
The user shall read the terms of the offer for sale carefully before purchasing any products or availing of any services on the website. Any purchase of the products/ services made by the user through the website shall signify the user’s acceptance of the terms of the offer for sale and the user’s consent to be legally bound by the same.
If there is any ambiguity in any of the terms and conditions enlisted on the website for an offer for sale the decision of ‘Chartered Express Connecting Professionals’ or Chartered Express’ shall be final.
IF USERS DO NOT AGREE WITH ANY OF THE TERMS OF OFFER FOR SALE MENTIONED ON THE WEBSITE, THEY SHALL REFRAIN TO TRANSACT THROUGH THIS WEBSITE FOR ANY PURCHASE.
1. Business
1.1 The Website ‘CE’ is a platform that facilitates the online sale of Products and services offered by ‘Chartered Express’ and its various affiliates/ registered merchants/ vendors/ service providers. Providers are the sellers of products and services on the Website and will be solely responsible to the buyers of their products or services.
1.2 The USER acknowledges that CE has the right to change or discontinue any facility at any time, without notice. The USER further acknowledge that CE may add or modify the procedures, modes, processes or conditions of purchase at any time in accordance to the changing circumstances.
2.Product
2.1 CE also makes available a variety of products at an agreed price to USER. Purchase of such products will be subject to the Terms of Offer for Sale and such other additional terms, if any, as specified by the Providers.
2.2 CE does not in normal circumstance offer SHIPPING of any of the products sold through the Website. The shipping would be done directly by the Seller or Service Provide to the Buyer.
2.3 All the Products are governed by the terms of warranties provided by the respective Seller / Service Provider.
3.Services
3.1 USER should take all responsibility for its own actions in utilizing the services purchased and CE shall not be liable for any such action.
3.2 CE does not offer any refunds against any product or services once purchased unless such products or service has not been delivered in reasonable time due to the fault of the CE.
4. Pricing Information:
4.1 The prices of the products and services offered on the website are fixed by the sellers or Service Providers and CE does not influence the pricing of the same except offering discount from time to time on its website. Prices and availability are subject to change without prior notice.
4.2. In the event that a product or service is listed at an incorrect price or with incorrect information due to a typographical error CE may INFORM THE USER about the cancellation of the order. The payment received will be remitted to USER at the earliest.
5. Delivery of the Product and services
5.1 The Buyer may provide us with an alternate shipping address as a cover in case the original shipping address is not serviceable by the delivery concerns such as Post office, courier, etc.
5.2 Orders placed for different destinations shall be placed separately even by a single Buyer.
6. Replacement Policy
6.1 In the event Buyer receives a damaged / defective product or a product that does not comply with the specifications as per the order placed, they are required to get in touch with CE at its designated email. Email – [email protected]
6.2 Upon receiving the Buyer’s complaint, CE shall verify the authenticity and the nature of the complaint and if convinced that the complaint is genuine, will inform the relevant Provider of such complaint and request for a replacement. However, in the event of frivolous and baseless complaints regarding the quality and content of the products, CE reserves the right to either ignore them or take necessary legal actions against the complainant who shall solely be liable for all costs incurred by CE in this regard. USER expressly acknowledges that the Seller/ Service Provider selling the defective product/ service will be solely responsible to the Buyer for any claims that Buyer may lodge about such defective product/ service and CE shall not in any manner be held liable for the same.
6.3 Before accepting shipment of any product, the Buyer shall ensure that the product’s packaging is not damaged or tampered with. If the Buyer observes that the package is damaged or tampered with, he/she shall refuse to accept delivery and inform CE at the earliest.
6.4 To replace any products sold through the Website, Buyers are required to comply with the below-mentioned conditions, viz:
- Please notify CE of receipt of a damaged/ defective product/service within 7 days of delivery to USER. If USER is unable to do so within7days, CE shall not be held liable for the failure to replace the order;
- ii. Products/Services should be unused;
- iii. Seller/ Service Provider will arrange pick-up of the damaged/defective product through its own logistics partner. In the event Seller/ Service Provider is unable to do so, CE will inform the Buyer regarding the same, and Buyer will be required to dispatch the product using a reputed courier within 24 hours from receipt of such notice. Courier freight charges may be reimbursed in such cases;
- iv. Products should be returned in their original packaging along with the original price tags, labels, barcodes, user manual, warranty card and invoices, etc.
- v. It is advised that the return packets should be strongly and adequately packaged so that there is no further damage of products during transit;
- vi. The returned products are subject to verification and checks by CE to determine the legitimacy of the complaint/ return.
7. Cancellation:
7.1 Cancellation by CE: There may be specific orders that CE is unable to accept and must cancel. CE reserves the right, at its sole discretion, to refuse or cancel any order for any reason whatsoever. Some situations that may result in order being cancelled include, without limitation, non-availability of the product or quantities ordered by USER, non- availability of the service, inaccuracies or errors in pricing information, or problems identified by CE’s credit and fraud avoidance department. CE may also require additional verifications or information before accepting any order. CE will contact buyer if all or any portion of order is cancelled or if additional information is required to accept the order. If the order is cancelled after buyer’s credit card has been charged, the said amount will be reversed back in the credit card account. A promo code/Discount coupon code, once used shall not be refunded in case of cancellation of order either by Customer or CE.
7.2 Cancellation by the User: In case of requests for order cancellations without any fault on the part of the CE or Sellers/Service Providers there shall be no refunds against the same.
8. Failure to Sell by the Provider:
8.1 Unless due to Buyer’s negligence, in the event the Provider fails to complete a sale of a product or a service the CE shall ensure that a refund of the amount paid by the Buyer is refunded at the earliest. . Further, the Buyer agrees that CE shall not be held liable for the failure of the Provider to make available any product or service therein.
9.Disclaimer
9.1 CE does not vouch for or guarantee the quality or usefulness or technical accuracy of the contents in the product or services purchased by the Buyer as it is only an online aggregator which facilitates the online sale and purchase of the products/services between Buyers and sellers/service providers.
10. Indemnity and liability.
10.1 Buyer agrees to hold harmless CE from and against any and all losses, liabilities, claims, damages, demands, costs and expenses (including legal fees and disbursements in connection therewith and interest chargeable thereon) payable by virtue of, any breach of any representation, warranty, covenant or agreement made or obligation to be performed by Buyer/ Seller or Service Provider with respect to the products and services sold on the Website including breach of contract or warranty, negligence or other tortious action, or any other claim arising out of or in connection therewith.
11. Jurisdiction:
11.1 The Buyer agrees that all claims, differences, and disputes arising on any transactions entered into on or through the CE Website shall be subject to the exclusive jurisdiction of the courts at Darbhanga and USER hereby accede to and accept the jurisdiction of such courts.
ALL LINKED TERMS AND CONDITIONS HEREUNDER ARE ASSUMED TO BE READ, UNDERSTOOD, AND AGREED UPON BY THE USER.
